Home inspectors are licensed by the NYS Department of State. Home inspectors may only report on readily accessible and observed conditions as outlined in our pre-inspection agreement, Article 12B of the Real Property Law and the regulations promulgated thereunder including, but not limited to, the Code of Ethics and Regulations and the Standards of Practice as provided in Title 19 NYCRR Subparts 197-4 and 197-5 et seq. Home inspectors are not permitted to provide engineering or architectural services.” ; and “If immediate threats to health or safety are observed during the course of the inspection, the client hereby consents to allow the home inspector to disclose such immediate threats to health or safety to the property owner and/or occupants of the property.

Florida

Senate Bill 2234, enacted June 27, 2007 as Chapter 468, Part XV, Florida Statutes, provides for licensure and regulation of home inspectors. Chapter 468, Part XV, Florida Statutes, became effective July 1, 2010, and provides that the home inspector licensing program will be administered by the Department of Business and Professional Regulation. There is not a Board of Home Inspectors. The department administers the licensure and regulation functions for this profession. Florida home inspectors must have a license to perform home inspections in Florida. The Florida Home Inspector bill, SB 2234, was passed on June 28, 2007 which requires home inspectors in Florida to carry a home inspector license and requires the same for mold remediators. The Florida Department of Business and Professional Regulation is the agency that will oversee home inspectors.
